CONTEST RULES

Thank you for your interest in participating in the “This is Our Miami” Video contest (the “Contest”). Please read the following rules concerning submissions.

In order to be eligible for the Contest, you must be a currently enrolled student or currently employed faculty or staff member at Miami University.  By entering this contest and clicking “I agree” below, you agree to be bound by these contest rules and the University’s decisions which are final and binding on all matters relating to the Contest.  If you click “I do not agree” then you will not be entered into the Contest.  Miami University may change these rules in its sole discretion at any time without notice. 

You may submit a video with the theme “This is Our Miami” by completing the entry form found on www.thisisourmiami.com or by delivering a digital file containing your video and a hard copy of the form found on www.thisisourmiami.com to the Division of University Advancement in the Advancement Services Building.  You may submit as many videos as you wish.  You must submit all requested information during the submission process.  The Contest submissions period begins at 12:00 a.m. on September 29, 2008 and ends at 12:00 a.m. on December 1, 2008.

All submissions will be reviewed by Miami University before they are posted. The University reserves the right to not post material which it finds to be inappropriate or objectionable for any reason.  The determination regarding whether to post a submission rests solely within the University’s discretion. 

All submissions must also comply with the terms of service and specifications for user submissions and/or video uploads.  Submissions must not include any third-party copyrighted media productions, including, without limitation, music, movies, books, art work, television programs, etc. 

All submissions which are not rejected by the University will be posted on the “ThisisOurMiami.com” site.  Your name will accompany your submission. If you are student, your major will also be displayed. If you are a faculty or staff member, your university title will be displayed.

You will retain ownership of the content of the submission, provided, however, the University is not responsible for maintaining or returning your submission.  The University reserves the right to destroy all submissions anytime after the end of the program.  Please keep a copy of your submission if you intend to use it in the future.  Although you will own the content of the submission, you grant Miami University an exclusive, perpetual, royalty-free license to use and reproduce the submission or any part thereof for the University’s educational, promotional and research purposes after the Contest.  Miami may edit all submissions for such purposes and may utilize some, all or none of each submissions for such post-Contest purposes.       

The contest will be decided by votes cast on ThisisOurMiami.com and first, second and third place prizes will be awarded.  Additionally, one “President’s Choice” award will be determined in the sole discretion of a  panel of Miami University staff and volunteers.  The prizes are listed below.  Miami University reserves the right to substitute any or all of the prizes with different prizes of approximately equal value. The winner will be notified via email on or about December 1, 2008.  In order to claim the prize, the successful entrant will have to sign an agreement transferring all copyright interest in the submission to Miami University as well as such other reasonable documentation as is required by Miami University. 

The Prizes are:
1st prize – Wii game system prize pack (~$500)
2nd prize – Polaroid 23 in LCD HDTV (~$300)
3rd prize – Flip Ultra Series Camcorder (~$150)
President’s Choice – Wii game system prize pack (~$500)

By submitting a letter, essay, or image, you are affirming that (1) you are its sole author or creator, (2) if you are submitting an person’s identifiable image, you are affirming that you have obtained that person(s)’ consent, (3) nothing within the submission could be considered defamatory of any person or entity, and (4) you did not violate any federal, state or local laws in producing the submission. 

BY PARTICIPATING IN THIS CONTEST, ENTRANTS WAIVE ANY AND ALL CLAIMS AGAINST MIAMI UNIVERSITY, ITS TRUSTEES AND EMPLOYEES FOR ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THIS CONTEST OR IN ANY CONTEST-RELATED ACTIVITY, OR ANY CLAIMS BASED UPON PUBLICITY RIGHTS, DEFAMATION, OR INVASION OF PRIVACTY.

Miami University reserves the right, at its sole discretion, to prohibit any entrant from participating in the Contest or to disqualify any individual it finds, in its sole determination, to be tampering with the entry process or the operation of the Contest; to be attempting to undermine the legitimate operation of the Contest, to be acting in violation of these Contest Rules, or to be acting in a disruptive manner, or with the intent to discredit the positive spirit of the Contest or with the intent to annoy, abuse, threaten, or harass another person

Ohio Law governs this Contest.  All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest, or the rights and obligations of Entrants and Miami University shall be governed by, and construed in accordance with, Ohio law.
