When an incident is reported to OESCR (either through incident report, police report, or private complaint), the first determination is whether or not the alleged violation is suspendable. 

If the alleged violation is not suspendable

Notification will be sent to the student with the proposed sanctions. The student may either:

  • Accept and complete the sanctions (Decision is final, no appeal)

- OR - 

  • Request either an Administrative Hearing or a Student Court Hearing.
    • If the student is found not responsible, a follow-up letter is sent and no disciplinary record is maintained.
    • If the student is found responsible, sanctions are issued and a follow-up letter is sent.  The decision is final, no appeal.

If the alleged violation is suspendable

  1. Notification will be sent to the student stating the date/time of a Procedural Review.
  2. The Procedural Review occurs, after which:
    1. The student may accept and complete the sanctions. A follow-up letter is sent.
      - OR - 
    2. The student may request an Administrative Hearing, a Disciplinary Board Hearing, or an Administrative Hearing Panel (Sexual Misconduct/Title IV). After the hearing:
      1. If the student is found not responsible, a follow-up letter is sent and no disciplinary record is maintained.
      2. If the student is found responsible, sanctions are issued and a follow-up letter is sent. If the sanctions include suspension or dismissal, the student may appeal the case.
